As a rule the mother receives the child benefits<\/strong>. <\/p>\n<\/div><\/div>\n\n

If the parents (whether or not married) separate, we still assume there is shared parental responsibility over the minor. Therefore the mother keeps receiving the child benefits.<\/p>\n<\/div><\/div>\n\n

Is there a change in this situation? Inform your personal case worker about it.<\/p>\n<\/div><\/div>\n\n

Minor children<\/h2>\n<\/div>\n\n
\n

If the child is underage<\/strong> and lives with its father, the father may request the child benefits agency in writing to pay the child benefits for his children to himself. The benefits are awarded from the month following the request onwards. If the father does not request this, the mother keeps receiving the child benefits.<\/p>\n<\/div><\/div>\n\n

Children of age<\/h2>\n<\/div>\n\n

If the child is of age<\/strong>, the child benefits are paid to the parent the child is living with.<\/p>\n<\/div><\/div>\n\n

How to notify Famiris of a separation?<\/h2>\n<\/div>\n\n
\n

In the event of a separation in Belgium<\/strong>, the municipality automatically informs us<\/strong> about the change in the child’s family situation.<\/p>\n<\/div><\/div>\n\n

\n

Once we are informed of the divorce, Famiris sends a letter with the necessary explanation to both parents. <\/p>\n<\/div><\/div>\n\n

\n

If the Family Court grants one of the parents exclusive parental authority<\/strong>, a complete, unaltered copy of the judgment must be sent to Famiris. The parent who exercices parental authority will receive child benefit from the month following receipt of the copy of the judgment.<\/p>\n<\/div><\/div>\n\n
